The Sarbanes–Oxley Act of 2002 requires company executives to certify financial statements and internal controls as a means of reducing fraud. Many companies have operationalized this by instituting a sub-certification process and requiring lower-level managers to sign certification statements. These lower-level organizational members are often the individuals who are aware of fraud and are in the best position to provide information on the fraudulent act. However, the sub-certification process may have the effect of reducing employees’ intentions to report wrongdoing. We (...) suggest that subordinates with knowledge of a superior who committed a fraudulent act and certified that there is no fraud will feel less personal responsibility to report the act, thus, decreasing reporting intentions. Additionally, we suggest that if the fraud is discovered subsequent to the reports being filed with the Securities and Exchange Commission, employees will perceive lower management responsiveness to investigate the fraud, which will reduce intentions to report. Using an experimental approach, we manipulate two between-participant variables: the presence or absence of sub-certification by the transgressor and the timing of fraud discovery, either before or after the reports have been filed with the SEC. We find that when sub-certification is present, perceived personal responsibility and intentions to report were diminished compared to when sub-certification is absent. Timing of the discovery of the fraudulent act did not influence perceived management responsiveness or reporting intentions. Supplemental analysis shows that personal responsibility partially mediates the relationship between sub-certification and reporting intentions. Our findings suggest that audit committees and senior executives may want to carefully consider the costs and benefits of the sub-certification process. (shrink)

Imitation recognition provides a viable platform from which advanced social cognitive skills may develop. Despite evidence that non-human primates are capable of imitation recognition, how this ability is related to social cognitive skills is unknown. In this study, we compared imitation recognition performance, as indicated by the production of testing behaviors, with performance on a series of tasks that assess social and physical cognition in 49 chimpanzees. In the initial analyses, we found that males were more responsive than females to (...) being imitated and engaged in significantly greater behavior repetitions and testing sequences. We also found that subjects who consistently recognized being imitated performed better on social but not physical cognitive tasks, as measured by the Primate Cognitive Test Battery. These findings suggest that the neural constructs underlying imitation recognition are likely associated with or among those underlying more general socio-communicative abilities in chimpanzees. Implications regarding how imitation recognition may facilitate other social cognitive processes, such as mirror self-recognition, are discussed. (shrink)

t is now well accepted that defined architectural compartments within the cell nucleus can regulate the transcriptional activity of chromosomal domains within their vicinity. However, it is generally unclear how these compartments are formed. The nuclear periphery has received a great deal of attention as a repressive compartment that is implicated in many cellular functions during development and disease. The inner nuclear membrane, the nuclear lamina, and associated proteins compose the nuclear periphery and together they interact with proximal chromatin creating (...) a repressive environment. A new study by Harr et al. identifies specific protein–DNA interactions and epigenetic states necessary to re‐position chromatin to the nuclear periphery in a cell‐type specific manner. Here, we review concepts in gene positioning within the nucleus and current accepted models of dynamic gene repositioning within the nucleus during differentiation. This study highlights that myriad pathways lead to nuclear organization. (shrink)

Terminally ill patients in 10 states plus Washington, D.C. have the right to take prescribed medications to end their lives (medical aid in dying). But otherwise-eligible patients with neuromuscular disabilities (ALS and other illnesses) are excluded if they are physically unable to “self-administer” the medications without assistance. This exclusion is incompatible with disability rights laws that mandate assistance to provide equal access to health care. This contradiction between aid-in-dying laws and disability rights laws can force patients and clinicians into violating (...) one or the other, potentially creating an underclass of patients denied medical care that is available to those with other (less physically disabling) terminal illnesses. The immediacy of this issue is demonstrated by a lawsuit in Federal court filed in August 2021, requesting assistance in self-administration for terminally ill patients with neuromuscular diseases. This paper discusses the background of this conflict, the ethical issues at the heart of the dilemma, and recommends potential remedies. (shrink)

A little more than a hundred years ago Eduard Sievers drew attention to the abnormal anacrusis in Beowulf 9b, þara ymbsittendra, and 402b, þa secg wisode. He had discovered that anacrusis, or Auftakt as he called it, though admitted with some frequency before verses of types A and D in the first half-line, was very rare in the second half-line, where the obligatory single alliteration on the first of two lifts seemed to call for a more limited range of syllabic (...) patterns. He found only seven or eight certain instances of anacrusis, invariably monosyllabic, before verses of type A , and only the two instances here in question before verses of type D. Were these two instances above suspicion, like those he had accepted as authentic before type A? He did not immediately pass judgment on the seemingly more irregular disyllabic þara of line 9b, but he noted at once that the þā of 402b could perhaps be omitted, since secg wisode would serve by itself as a parenthetic clause parallel to the preceding snyredon ætsomne. No doubt he was aware that secg wisade had occurred as an independent clause in a paratactic series at line 208b. Yet he proposed the omission of þa somewhat tentatively, with a vielleicht. A few years later he took more decisive action against the þara of line 9. Having occasion to quote the passage containing it in another connection, he enclosed þara in brackets as a sign that the word was to be canceled. (shrink)

Pope Francis has called for the Church to be a sign of mercy and hope to the world. Mercy stands at the center of the Gospel, and the family is a fundamental seat of mercy within the culture, responsible for bestowing the most valuable of God’s gifts, human life. Because of its mission to bestow life, marriage is necessarily a “lifelong covenant of love and fidelity between a man and a woman”. As the Church upholds the view of marriage (...) exclusively as the union of a man and a woman who are capable of reaching the deepest kind of unity, she also affirms that persons of the same sex can achieve unity in meaningful ways. Upholding the traditional, comprehensive view of marriage does not belittle the dignity of homosexual persons, because all are our brothers and sisters. (shrink)

This article examines humanist works written in the immediate aftermath of Stefano Porcari's failed conspiracy against Pope Nicholas V. While they were designed to flatter the pope and support papal claims to temporal power, these works use images and adopt rhetorical startegies that are republican and not, as one would expect, imperial in origin. The humanists were so devoted not only to classical form, but also to Roman republican ideals that they sometimes present Porcari positively, have heroes of (...) the Roman republic comment on the modern papacy, and construct a strained theory of papal liberty. This study responds to Bay and Greenberg's (Bay, D.D. and Greenberg, R.R. (2001). The relationship of the DIT and behavior: A replication. Issues in Accounting Education 10(3): 367–380) call to investigate alternative psychometric instruments to measure ethical behavior other than the heavily relied upon Defining Issues Test. The Mach IV scale (Christie, 1970) has been cited in more than 500 published psychological studies; however, it has not been used extensively in the accounting ethics research. This study provides some preliminary evidence (...) on the use of the Mach IV scale in an accounting ethics context. Similar to ethics studies in other academic disciplines, results across two dependent measures indicate accounting students high in Machiavellianism are more likely to view questionable ethical behavior as acceptable. The research findings also indicate that the Machiavellian construct appears to be a better predictor of ethical propensities in comparison to the commonly used Defining Issues Test. The paper concludes with a discussion on how these reported research findings impact the accounting profession and accounting education. (shrink)

Discrepancies between the Uniform Determination of Death Act (UDDA) and the adult and pediatric diagnostic guidelines for brain death (BD) (the “Guidelines”) have motivated proposals to revise the UDDA. A revision proposed by Lewis, Bonnie and Pope (the RUDDA), has received particular attention, the three novelties of which would be: (1) to specify the Guidelines as the legally recognized “medical standard,” (2) to exclude hypothalamic function from the category of “brain function,” and (3) to authorize physicians to conduct an (...) apnea test without consent and even over a proxy’s objection. One hundred seven experts in medicine, bioethics, philosophy, and law, spanning a wide variety of perspectives, have come together in agreement that while the UDDA needs revision, the RUDDA is not the way to do it. Specifically, (1) the Guidelines have a non-negligible risk of false-positive error, (2) hypothalamic function is more relevant to the organism as a whole than any brainstem reflex, and (3) the apnea test carries a risk of precipitating BD in a non-BD patient, provides no benefit to the patient, does not reliably accomplish its intended purpose, and is not even absolutely necessary for diagnosing BD according to the internal logic of the Guidelines; it should at the very least require informed consent, as do many procedures that are much more beneficial and less risky. Finally, objections to a neurologic criterion of death are not based only on religious belief or ignorance. People have a right to not have a concept of death that experts vigorously debate imposed upon them against their judgment and conscience; any revision of the UDDA should therefore contain an opt-out clause for those who accept only a circulatory-respiratory criterion. This article is written from within the Catholic, and more particularly the Augustinian/Thomist tradition of moral theology. It analyses the response of the Catholic Magisterium to the prospect of germline-genetic engineering (GGE). This is a very new issue and the Church has little definitive teaching on it. The statements of Popes and Vatican congregations or commissions have not settled the key questions. An analysis of theological themes drawn from secular writers points beyond pragmatic safety considerations toward intrinsic ethical limits to (...) GGE. Given the impossibility of identifying would-have-been-created persons who would be “treated” by this intervention, altering the human genome for the sake of future generations cannot be regarded as “therapy.” Further theological considerations suggest that GGE may not be morally permissible, even in the case of identifiable genetic diseases. Adding to an already quite impressive collection of writings on the 16th century and particularly on Erasmus, Professor Hyma has given us a most interesting account of some of the scholarly controversies which have attended the study of Erasmus’ life. Convincingly Hyma argues that there is no reason for assuming that Erasmus was publicly abusive of Pope Julius. Erasmus’ relationship with Luther, on reading Hyma’s account, becomes quite complex and many-faceted. Abstract: Giorgio Agamben's recent works have been preoccupied with a certain obscure passage from St. Paul's 'Second Epistle to the Thessalonians,' which describes the portentous events that must occur before the Second Coming of Jesus Christ can take place---specifically, the appearance of a 'man of lawlessness' (the Antichrist?) and the exposure of who or what is currently restraining the 'man of lawlessness' from being exposed as the Antichrist: a mysterious agency called the 'katechon.' In 'The Mystery of Evil: Benedict XVI (...) and the End of Days,' this obscure passage is connected with the abdication of Pope Benedict XVI through certain equally obscure references to the fourth century theologian, Tyconius, although the precise connection between these apocalyptic events and their mysterious agents remains obscure. This review attempts to shed some critical light upon this cryptic subject, both by considering the world-historical context of St. Paul's epistle, and by asking what role these apocalyptic figures play in Agamben's political theology. But, to begin with, the review also asks: Who, really, is the Antichrist? a scarcely rhetorical question that demands a sardonic answer. Although various candidates from contemporary politics are proposed, the review finally argues that the Antichrist and the katechon are not specific individuals or worldly institutions, but rather refer to world-historical trends within Western European Christian civilization itself that have resulted in what Friedrich Nietzsche called 'the devaluation of all higher values' and 'the desecration of the Christian moral world-view': an apocalyptic turn of events which Nietzsche equally sardonically referred to in 'The Antichrist.'. In the face of the external challenge of the Protestant Reformation, as well as the internal threat of spiritual, moral, and disciplinary corruption, two Catholic saints worked tirelessly to reform the Church in different but complementary ways. Philip Neri (1515–95) and Charles Borromeo (1538–84) led the Catholic Counter–Reformation during the middle–to–late sixteenth century, placing their distinctive gifts at the service of the Church. Philip Neri used his personal humility, intelligence, and charisma to attract the people of Rome to Christ, while (...) Charles Borromeo employed his gifts for administration and his experience as a top aide to the pope to promote needed institutional reform. Both men achieved great personal holiness and moved others to holiness of life. It is their response to and sharing of the ‘universal call to holiness’, then, that constitutes the core of both of their approaches to ecclesial reform. Their focus on holiness, expressed in an emphasis on either the ‘charismatic’ or ‘hierarchical’ dimensions of the Church’s life, also provides a model for today’s Church, scarred as she is by scandal and in need of a new movement of reform. In a previous study, I argued that Kant was guided throughout his intellectual career by a few fundamental insights regarding what, broadly, has been called “teleology.” In particular, I argued that Kant’s Critical and utterly original conception of the structure and unity of reason as teleological evolved out of his pre-Critical attempts to perfect the theocentric teleology typical of – to take just two relevant examples – Christian Wolff and Alexander Pope. In this process, Kant came to the general (...) view that the previous picture of the cosmos as unified into an inexhaustibly productive and infinitely dense nexus of ends has its source in the intrinsic “needs” of finite human reason. The last few years are the time of the ongoing integration of Europe and its vivid discussion about it. The thorny issue is the role and the place of Christianity in the life of Europe. Pope John Paul II had authoritatively taught on the issue. His teaching is a kind of antidote against those who are in favour of Europe without God. The European culture is not a monolith since it is inhabited by many nations with a different characteristic (...) but all are rooted in the same values of the Good News acknowledged on the Continent. The present time – and especially the centuries after the Enlightenment – seems to be the time of abandoning Christianity. As the result of such a process, Europe witnessed two totalitarian systems responsible for numerous crimes. A human being wanted – without God’s participation - to decide about right and wrong. They were tempted like the first parents in Eden. They were changed from godlike humans to objectified ones – from “homo sapiens to homo demens”. John Paul II and many authors dealing with the processes of mankind underlined the need to build unity in Europe in close connection to Christianity. Christianity is an important element of culture in which the man is not restricted to his mortal life but opens up for a supernatural perspective. Through Christianity the European culture is richer and the man fully developed. Taking Christianity into consideration in his life, man can discover the truth about himself and his true relation to God. Only the truth allows man to grow and achieve his perfection, whereas falseness condemns him to the degeneration. (shrink)

This article consisting of four points, shows the subject of multiple relationships between the realities of politics, ethics and the Catholic Church. The issue was presented on the basis of the writings and speeches of Joseph Ratzinger, the current Pope Benedict XVI. Article begins with a presentation of the relationship between politics and ethics as seen in historical perspective. The second section presents the so-called „political ethics” of the first Christian communities in the light of the indications contained in (...) some of the New Testament writings (cf. 1 Thess; 1 Peter) being the basis for the Christian way of acting in the area of policy. The third section indicates some realities like: progress, science and freedom – considered sometimes as an unquestioned idols and that`s why named once by Ratzinger „myth of modernity” – as a threat to connectivity between politics and ethics. The fourth section discusses the teaching of the Catholic Church on politics and the need for its ethical practice. In addition it contains some concrete proposals of Ratzinger that can be used in contemporary debates on the fundamental values of a democratic state in contemporary pluralistic societies. It also refers to Pope Benedict XVI appeals for more ethics of politics. (shrink)

It is a commonplace notion that the issue of human rights is a recent one, an inheritance of the Enlightenment. The teaching of the recent Popes, however, indicates that the issue of human rights is also an inheritance ofChristianity. The article demonstrates that, in fact, the essential structure of the notion of human rights was object of the attention of the earliest Christians, especially when the power of Rome accepted a wide variety of cults for the sake of its calm (...) scepticism, and at the same time opposed the Christian communities precisely because they were Christian. In this way, the concept of human rights found a first formulation regarding the protection of human beings and their dignity, not only in favor of Christians, but on the basis of universal norms founded in the unique Creator of all human beings. This essay argues that a restatement of Thomistic natural law reasoning is increasingly necessary in jurisprudential debate about international law. Mindful of Pope John Paul II's call for a renewal of international law, the essay engages with the present-day tension between Morgenthau-type realism and neo-Kantian discourse-oriented cosmopolitanism. The essay addresses whether the former is sufficiently realistic in our global 21st century context, and whether the latter is adequately cosmopolitan. Attention is drawn to Aquinas's understanding of the relation between custom, (...) consent and political authority in order to expose some of the limits of present-day statism, and to suggest that Thomistic natural law reasoning is, potentially at least, better able to cope with the intractable disagreement that characterises 21st century global relations than some forms of neo-Kantian jurisprudence. A review of Giorgio Agamben's The Mystery of Evil: Bendict XVI and the End of Days, which attempts to place Agamben's peculiar argument regarding Pope Benedict's abdication in the context of his reading of St. Paul's 2 Thessalonians 2:1-12, and, more generally, in terms of his political-theology in the Homo Sacer series. The questions, 'Who is the Antichrist?' and 'Who (or what) is the katechon?' are also explored, in the attempt to translate Agamben's obscure theology into contemporary political terms.

This article will examine Bellarmine’s first anti–conciliarist work, found in the Disputationes de controversiis Christianae fidei adversus huius temporis haereticos, emphasizing his theological treatment of the pope’s authority relative to the authority of a council and his repudiation of conciliarism. Bellarmine sees the conciliarists as attacking the divinely instituted Petrine structure of the Church. He does not advocate for an absolute papal monarchy in which there are no ‘constitutional’ limitations on the papacy. For Bellarmine, Christ and his Word, as (...) found in Sacred Scripture and Apostolic Tradition, have supreme authority in the Church: one which the magisterium, whether papal or conciliar, must accept in humility and pass on unsullied. Only Christ has a true fullness of power; the pope has a fullness only relative to that of the bishops. Nevertheless, Christ immediately instituted the pope as the supreme head of the Church on earth, and as such, the pope has supreme ecclesiastical power over the whole Church on earth. He was invited (...) to reflect on the Second Vatican Council, to ask questions to leading curial figures, and peritus theologians, as well as Pope Paul VI. Barth's book Ad Limina Apostolorum: An Appraisal of Vatican II contains his questions and an account from Barth of his visit, along with some other important essays. It is still deeply challenging in its incisiveness, despite its brevity. I have always been struck by Barth's Marian criticisms that are so central to his viewpoint about divine agency and human cooperation. These give us an excellent insight into his ecclesiology. They represent the reasons for much of his questioning of various Roman Catholic positions on all sorts of matters. Eberhard Busch's diaries, while Barth's assistant during this period, form a fascinating complimentary account of the visit. These tell of the not-so-fruitful visit to Augustin Cardinal Bea and the great highpoint (for Barth) of his one-hour audience with Pope Paul VI. Barth was impressed by the Jesuits during his visit, but not so much by the Dominicans. He thought the latter had absorbed too many streams of liberal modernity. The two Dominicans participating in this book turn those tides. Indeed, all the authors could be located within the conserving wings of their ecclesial membership, which makes the volume all the stronger in raising serious unresolved disagreements and noting important common ground. It is testimony to Barth's enduring value that this volume seems so timely. The Barth Centre at Princeton and the Pontifical Faculty of the Dominican House in Washington were the sponsors of this collection.The volume is structured around five of the key documents commented on by Barth, with a Catholic and Reformed voice reflecting on both the particular document and Barth's input (with the exception of Francesca Aran Murphy, who deals with George Lindbeck rather than Barth), thereby simultaneously pushing forward the Catholic–Reformed engagement with the Council and with Barth. There is a preface with a penetrating introduction by Thomas Joseph White, O.P., and an irenic opening chapter by Matthew Levering on biblical renewal at Vatican II. Then follow the twin reflections on the five documents.First (and rightly so) comes the Dogmatic Constitution on Revelation, Dei Verbum. Katherine Sonderegger develops a nuanced reflection on the metaphor of Scripture as mirror of God (found in Dei Verbum), showing [End Page 971] a deep appreciation of currents within Dei Verbum that Barth had not detected, but which are more connective with his concerns and preoccupations. Lewis Ayres rather impishly takes what Barth saw as the main weakness of the text (its chapter 2: "Handing on Divine Revelation") and makes it the greatest strength. Ayers provides a deeply learned and original exploration of the concept of "tradition" as sacramental. In this duet, Barth comes out looking like he may have missed hearing the melodies while too closely studying the score.Then follow two profound essays on Lumen Gentium, the Dogmatic Constitution on the Church. Christoph Schwöbel builds up a strong Protestant case for the necessary visible ecclesial identity of the Church, thus showing a deep convergence without denying differences that remain. White, in a deeply insightful and probing essay, goes to the heart of the ecclesiological difference between Barth and Yves Congar (and some other key Catholics at the time): the relationship between uncreated divine agency and created human agency, especially within the context of the post-apostolic Church. White suggests that, without some stable ecclesial mediations, there can be no proper relationship envisaged between the transcendent causality of God operating in Christ and the created, active cooperative acts with this grace. I provide a number of quotations from Hobbes, Locke, Pope, Addison, Dryden, and others to make the point that there was an unresolved tension between wit and judgment, imagination and reason, and rhetoric and philosophy, throughout the period.

The author discusses the effects of contraception, which have borne out the predictions of Pope Paul VI's encyclical Humanae Vitae: the explosion of out-of-wedlock births, lack of respect for women, STD's, HIV/AIDS, etc. The overpopulation claims that fed the acceptance and promotion of contraception have been discredited by demographers; now the social costs of underpopulation are increasingly apparent. Acceptance of contraception has now also led to an embracing of morally objectionable technologies like cloning. In this succinct survey of a period four centuries ago, when even papal prelates welcomed the reviving classical humanism as a refreshment from the dull formulas of a hidebound scholasticism, whose best upholders were struggling to rescue its original spirit from established senescence, Father Bouyer directs his sympathy and acumen to evaluate humanist Christianity in its central and most controversial figure, Desiderius Erasmus and in particular to the striking attempt to establish a humanist theology. Unfortunately for English readers his study (...) concentrates upon ‘the spirit and general trend’ of Erasmus, exemplified in the significant Basel years, ‘when “Erasmianism” showed itself clearly as lying between the ultra-conservative Catholicism and the Protestant innovators’, and for this purpose critically expounds the Etudes erasmiennes of the late Professor Renaudet, ‘the examination of which’ he frankly admits ‘will form the core of our work’. Thus this work is mainly a translation of Fr. Bouyer’s Autour d’Érasme which sprang from the French literary scene in 1955 with the addition of an introductory sketch of the chief Renaissance prelates, initially led by Nicholas of Cusa, Vittorino da Feltre and Pico della Mirandola and concluding with ‘its final blossoming in the group of cardinals surrounding Pope Paul III’. Text visualization is the technique of using graphs and charts to examine text as data. Often, these do not represent a text directly and instead display an output based on word counts, word sequences, and so on. This technique can provide insights into important keywords in a text, provide an overview of textual content, or reveal trends and patterns within one text or across many texts. This paper describes recent development of and experiments with several tools for the Grub Street (...) Project to generate visualizations of eighteenth-century texts, especially in terms of the spatial relationships of words and entities on the pages of the original documents. Two examples are discussed in this article as test cases: Edward Ward’s The London Spy Compleat, in Eighteen Parts (1703) and Alexander Pope’s The Dunciad. With Notes Variorum (1729). (shrink)

In his writings, Pope Francis describes a culture of interfaith and intercultural encounter as the foundation of lasting peace, friendship, and reconciliation among peoples. Far from superficial, a culture of encounter is built upon the slow work of honoring differences and forming social bonds across differences. In the first part of this paper, the authors investigate correspondences between the theology of encounter in the teaching and witness of Martin Buber and Pope Francis, in which the sacred, the ground (...) of reality, and the potential for redemption are revealed in the engaged space “between” self and other. In the second part of the paper, they explore how these ideas are actualized in practices of nonviolence, such as dialogue. In conclusion, they identify how these ideas and role models suggest a road map to build a culture of nonviolence and just peace through encounter within fractured societies throughout the world today. This stoutly handsome tome is the first publication of a five-volume English version of the comprehensive set of Herder commentaries upon the declarations and decrees of the Second Vatican Council. Much ink has been spilled upon these topics and texts in detail; now comes the time for their consolidated appreciation. Four decrees are analysed here in their historical formation and exegetic text out of the sixteen promulgated after much heart-searching—and some organizational confusion —by the Council Fathers in collegiate unity with (...) the Pope. This valuable collection of lectures, articles and interviews is a rare introduction to an octogenarian scholar and a decisive leader in the new development of ecumenical theology, who is revealed at work immediately preceding the opening of the Second Vatican Council. Cardinal Bea has shown a notable talent for lucid explanation in public as well as quiet insistence upon basic principle in the sympathetic appreciation of the endemic divisions among Christian believers, which inevitably blur the image of Christ for thinking (...) non-Christians. In correction the creative example of Pope John was ‘intended to read the lesson of a new approach’ which the Introduction of the late Apostolic Delegate to Britain succinctly notes. (shrink)

An analysis is made of Pope Francis’ Encyclical Laudato Si from a general systems approach. A call is made for a dialogue between theologians and environmental scientist. A parallel is found between the Pope’s identification of rapidification as a root cause of global warming and McLuhan’s notion of the speedup of modern life due to the emergence of electric technology. An analysis of Hebrew Scriptures is made, suggesting that rather than subduing the earth, the translation of Gen 1:28 (...) seems to indicate that the intention was to occupy and tend the land. The Jewish notion of Bal Tashchit one of the 613 mitzvos or commandments from Scripture, supports this interpretation as it calls for stewardship of G-d’s gifts. (shrink)
